Criminal Code of Canada:  (Prohibited Behaviour)

The effects of alcohol are more pronounced (and dangerous) at sea.

Alcohol, drugs or controlled substances could impair your judgement and ability to safely operate your pleasure craft.  It is a Criminal Code offence to operate a pleasure craft while impaired.  In addition to federal penalties, (fines or jail), Ontario offenders also lose their motor vehicle drivers licence for at least a year!  Other Provinces are adopting similar steps.

  • It is an offence to refuse to stop and give a breath sample.
  • It is an offence to operate a pleasure craft while prohibited.
  • Pleasure Craft also includes paddle boats, canoes & kayaks.

  • It is an offence to operate a pleasure craft in any manner that is dangerous to the public.
  • If involved in an accident, pleasure craft operators must stop, and offer assistance.  Failing to stop, and offer assistance is an offences.
  • Poorly maintained, leaky, or overloaded pleasure craft are not seaworthy.  It is an offence to knowingly operate a boat that is not seaworthy.
  • Search & Rescue resources are very limited.  Therefore, do not use your radio, flares, or any other means to (falsely) indicate distressSending false messages is an offences.
  • Water-skiers, wake-boarders, tube riders, kite fliers, etc. must be watched by someone onboard the towing vessel, (other than the driver).  It is an offence if you fail to have another person onboard, keep watch on a person being towed.
  • Seeing a person in the water, especially at night, is extremely difficult.  You may even run over them before seeing them.  Towing a person after dark is an offence under the Criminal Code of Canada.
  • Buoys, Daybeacons, Ranges, and other marine signals are vital for safe navigation,  They must remain visible, and in their advertized position. Use your anchor, instead of tying to a buoy, signal, or any other sea mark used for the purposes of navigation.  Do not wilfully alter, remove or conceal any sea mark used for navigation.  Interfering with a marine signal is a Criminal Code offence.
